Obergerfell v. Hodges

    Obergerfell v. Hodges is the U.S. Supreme Court landmark case decided in June 2015 in which the Court held that the 14th Amendment requires states to license and recognize same-sex marriage.Justice Kennedy delivered the opinion. The opinion states that affirming same-sex marriage is based on four underlying principles. Here’s the quote: “Four principles and traditions demonstrate that the reasons marriage is fundamental under the Constitution apply with equal force to same-sex couples.”The entire opinion is 103 pages, but the Syllabus is about 5 pages. The Syllabus describes in a nutshell Justice Kennedy’s four principles and traditions and then sends us to the pages in the opinion where we can read more about each one.
